Terms of Service

These Terms of Service (“Terms”) are an agreement between you and John Farrell (“we”, “us”) governing your use of Merge & Tell (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Merge & Tell watches your merged GitHub pull requests and uses AI to draft marketing content from them. You review, edit, and approve drafts; the Service can then publish the ones you approve to the social platforms you connect.

2. Eligibility and your account

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the activity under your account and for keeping access to your email inbox secure, since sign-in is by magic link. Tell us promptly if you suspect unauthorized use.

3. Connected accounts and third-party platforms

The Service connects to third-party platforms including GitHub, X, Bluesky, Mastodon, and LinkedIn. Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them, including any rules on automated posting, rate limits, and content. We are not responsible for third-party platforms, and they may change or revoke access at any time, which can interrupt the Service.

4. Acceptable use

You agree not to use the Service to:

  • post spam, or violate any connected platform’s terms or policies;
  • publish unlawful, infringing, deceptive, harassing, or harmful content;
  • impersonate another person or misrepresent your affiliation with anyone;
  • attempt to breach, overload, reverse-engineer, or disrupt the Service or its security; or
  • use the Service to build a competing product.

5. Your content

You retain ownership of the content you provide and the content you approve for publication (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate the Service for you — including sending pull-request data to our AI provider to generate drafts and publishing approved posts to the platforms you connect. You represent that you have the rights necessary to do this.

6. AI-generated drafts

The Service generates drafts automatically, and AI output can be inaccurate, misleading, or unsuitable. You are solely responsible for reviewing every draft before it is published and for the content you approve. We make no warranty that drafts are accurate, appropriate, or fit for any purpose.

7. Paid plans

Some features require a paid subscription. If you subscribe:

  • fees, billing period, and included usage are shown at checkout and billed in advance through our payment processor, Stripe;
  • subscriptions renew automatically for the same period until you cancel, and you authorize us to charge your payment method each renewal;
  • you can cancel at any time, effective at the end of the current billing period; and
  • except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods.

We may change our prices or plans on reasonable notice; changes apply to the next billing period.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and we handle your data as described in the Privacy Policy.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms or of any third-party platform’s terms.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date and, for material changes, take reasonable steps to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Connecticut, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there.
